Former swimming coach Kyle Daniels will not face a third trial over allegations he sexually touched underage girls during swim sessions, a court has heard.

Sydney Downing Centre District Court was told On Friday the Director of Public Prosecutions would not proceed with any further legal action against the 24-year-old.

The decision comes less than two months after a jury was unable to reach a verdict on more than half of the allegations that Mr Daniels sexually touched nine girls on Sydney’s lower north shore between 2018 and 2019.

Daniels was found not guilty on 10 of the other counts against him, with the jury delivering verdicts on five, four and one charge over the course of three weekdays.

These included the most serious allegations he had inserted his fingers inside the vaginas of some of the girls, which under the law were charged as sexual intercourse with a child under 10.

However, the jury was discharged when they were unable to reach a verdict for six counts of sexual touching of a child and five counts of indecent assault.

Mr Daniels pleaded not guilty to all charges before the court, and has always denied any wrongdoing.

On Friday, the court heard the charges would be dropped by the DPP and Mr Daniels would not have to endure a fresh trial.

Judge Kara Shead noted there was an application for costs which will be heard in March next year.

The girls were aged six to 10 years old.

He was arrested in early 2019 after two girls’ families raised concerns.
