Former President Donald Trump‘s ex-lawyer Eric Herschmann said he penned the note that Cassidy Hutchinson said she wrote on January 6, which was shown as evidence during Tuesday’s explosive hearing. 

‘The handwritten note that Cassidy Hutchinson testified was written by her was in fact written by Eric Herschmann on January 6, 2021,’ a spokesperson for Herschmann told ABC News late Tuesday. ‘All sources with direct knowledge and law enforcement have and will confirm that it was written by Mr. Herschmann.’ 

Herschmann reportedly previously told the House select committee on January 6 committee that he had scrawled the note in question. 

Herschmann had worked as a lawyer for Trump within the White House, but cooperated with the House investigation, including saying that some of the plots to overturn the election were ‘nuts.’  

Hutchinson worked under White House Chief of Staff Mark Meadows and the handwritten message was written on his letterhead. 

She testified that Herschmann was also in the meeting where they discussed something Trump could say to call off the Capitol attack. 

‘Anyone who entered the Capitol without proper authority should leave immediately,’ the message reads. 

The word ‘illegally’ is crossed out. 

‘That’s my handwriting,’ Hutchinson told committee members during her Tuesday testimony. 

She testified that Meadows had handed her the notecard and a pen and started dictating a statement for the president as the Capitol was getting ransacked. 

Hutchinson said Herschmann suggested changing the statement changing ‘illegally’ to ‘without proper authority.’  

The January 6 committee downplayed that one of its witnesses was misremembering details about the memo. 

While Hutchinson and Herschmann ‘may have differing recollections of who wrote the note,’ the spokesperson said, the important thing was that ‘both White House officials believed that the president should have immediately instructed  his supporters to leave the Capitol building.’ 

Hutchinson’s lawyers told CNN Wednesday afternoon that she stood by her whole account. 

‘Ms. Hutchinson stands by all of the testimony she provided yesterday, under oath, to the Select Committee to Investigate the January 6th Attack on the United States Capitol,’ said lawyers Jody Hunt and William Jordan. 

The meeting took place around 3 p.m. and Trump didn’t send out a message to supporters until 4:17 p.m. telling them, ‘We love you. You’re very special. You’ve seen what happens. You’ve seen the way others are treated. … I know how you feel, but go home, and go home in peace.’  

Trump reacted to the note being presented as evidence by posting to Truth Social: ‘Bad handwriting, that of a Whacko?’

Trump continued to go after his one-time aide Hutchinson using his Truth Social platform on Wednesday.  

‘The lies and fabricated stories being told to the partisan Highly Unselect Committee, not only by the phony social climber who got caught yesterday, but by many others, are a disgrace to our, in serious decline, Nation,’ the ex-president wrote.  

Trump bemoaned that there was ‘No cross examination, no real Republicans, no lawyers, NO NOTHING.’ 

‘Fake stories and an all Fake Narrative being produced, with ZERO pushback allowed,’ he continued. ‘Unselects should be forced to disband.’ 

He ended the post with a phrase he had previously used about the Russia investigation: ‘WITCH HUNT!’  

Trump has been trying to hurt the reputation of Hutchinson since Tuesday’s surprise hearing of the House select committee on January 6.  

‘I hardly know who this person, Cassidy Hutchinson, is, other than I heard very negative things about her (a total phony and “leaker”), and when she requested to go with certain others of the team to Florida after my having served a full term in office, I personally turned her request down,’ Trump wrote as the 25-year-old testimony was ongoing.

Hutchinson worked in Trump’s White House on the legislative affairs team and under Chief of Staff Mark Meadows.  

She provided embarrassing anecdotes about Trump’s behavior during her testimony – including that he tried to grab the wheel of the presidential limo, the ‘Beast,’ after he was told he couldn’t go to the Capitol Building on January 6 and threw food at the wall after Attorney General Bill Barr said there was no widespread fraud in the 2020 election.

He suggested that Hutchinson only played ball with the Democrat-led committee because he didn’t give her a job at Mar-a-Lago after he departed the White House in January 2021. 

‘I understand that she was very upset and angry that I didn’t want her to go, or be a member of the team,’ Trump said. ‘She is bad news!’ 

In another post on Truth social, Trump also accused Hutchinson of changing her story.

‘Her Fake story that I tried to grab the steering wheel of the White House Limousine in order to steer it to the Capitol Building is “sick” and fraudulent, very much like the Unselect Committee itself – Wouldn’t even have been possible to do such a ridiculous thing,’ Trump wrote. 

Later Tuesday, the January 6 committee tweeted out footage of Trump departing the Ellipse rally in a black SUV that purportedly shows his hands moving toward the driver. 

‘Her story of me throwing food is also false…and why would SHE have to clean it up, I hardly knew who she was?’ the former president added. 

After Hutchinson’s testimony concluded, Trump continued to go after her on Truth social. 

‘Her body language is that of a total bull…. artist. Fantasy Land!’ he wrote.

Trump has a history of turning on former aides and ex-political allies, a roster that now includes former Vice President Mike Pence and current Senate Minority Leader Mitch McConnell. 

During the hearing, Hutchinson recalled an impromptu meeting on January 6 after Trump returned to the White House after speaking at the Ellipse she had with former Deputy Chief of Staff Tony Ornato and Bobby Engel, the head of Trump’s security detail. 

‘Did you hear what effing happened in the Beast?’ she said Engel asked her. 

She replied that she hadn’t heard. 

‘Tony proceeded to tell me that when the president got in the Beast he was under the impression from Mr. Meadows that the off-the-record movement to the Capitol was still possible and likely to happen, but that Bobby had more information,’ Hutchinson said.

Trump, Hutchinson said, thought they were going up to the Capitol – like he had told his crowd of supporters he would do. 

This was in the hours before the attack. 

‘When Bobby had relayed to him we’re not, we don’t have the assets to do it, it’s not secure, we’re going back to the West Wing, the president had a very strong, very angry response,’ Hutchinson continued. 

She was told that Trump said something like: ‘I’m the effing president, take me up to the Capitol now!’ 

Engel, she said, reiterated that they were headed back to the White House. 

‘The president reached up toward the front of the vehicle to grab at the steering wheel, Mr. Engel grabbed his arm and said, “Sir, you need to take your hand off the steering wheel, we’re going back to the West Wing, we’re not going to the Capitol,”‘ she said. 

‘Mr. Trump then used his free hand to lunge toward Bobby Engel and when Mr. Ornato had recounted this story to me he motioned toward his clavicles,’ Hutchinson said, as a sign the president went for Engel’s throat.  

GOP Rep. Liz Cheney then asked Hutchinson if Engel or Ornato ever changed their stories. 

‘Neither Mr. Ornato or Mr. Engel told me ever that it was untrue,’ Hutchinson testified. 

After Hutchinson’s testimony wrapped, multiple news outlets reported that Secret Service officials planned to dispute her claims about what happened in the presidential SUV. 

From there, Hutchinson talked about Trump throwing dishes when being served with bad news. 

She said she remembered ‘hearing noise’ on the heels of the Associated Press article being released in which Barr confirmed that Trump’s widespread election fraud claims weren’t real. 

Chief of Staff Mark Meadows was summoned to Trump’s office. 

When Meadows returned Hutchinson said she walked down toward the White House dining room. 

‘And I noticed that the door was propped open and the valet was inside the dining room changing the tablecloth off of the dining room table,’ she said. ‘He motioned for me to come in and then pointed toward the front of the room near the fireplace mantel and the TV.’ 

‘Where I first noticed there was ketchup dripping down the wall,’ she continued. ‘And there’s a shattered porcelain plate on the floor.’ 

‘The valet had articulated that the president was extremely angry at the attorney general’s AP interview and had thrown his lunch against the wall,’ she said, explaining that she then helped with the clean-up.

Cheney then asked Hutchinson if this was typical Trump behavior. 

‘There were several times throughout my tenure with the chief of staff that I was aware of him either throwing dishes or flicking the table cloth to let all of the contents of the table go onto the floor and likely break or go everywhere,’ Hutchinson volunteered.
