Johnny Depp has avoided making eye contact with Amber Heard throughout their blockbuster trial because he vowed in 2016 that she would never see his eyes again, the court has heard.

The actress testified yesterday that she has tried to look her ex-husband in the eyes during their $100million defamation trial but he has avoided her gaze.

Depp’s attorney Camille Vasquez asked Heard on the stand: ‘Mr Depp hasn’t looked at you once in this entire trial, has he?’

Heard replied: ‘Not that I’ve noticed, no.’

Vasquez then said: ‘You’ve looked at him though many times, haven’t you.’

After Heard confirmed she had, Vasquez then said: ‘He promised you would never see his eyes again, isn’t that true.’

The Aquaman star replied: ‘I don’t recall that.’

An audio recording was then played to the Fairfax, Virginia, courthouse taken in a San Francisco hotel room in 2016.

It was taken after Heard had filed for divorce and obtained a restraining order against the Pirates of the Caribbean star.

In the recording, Heard tried to hug Depp but when he refused, she said: ‘Please I just want to hug you and say bye.’

Depp then is heard saying: ‘I am nothing to you, and I will always be nothing to you. You will not see my eyes again.’

In one tense moment, the pair did come face to face and make eye contact in a previous day in court, causing Heard to physically shudder.

The actress was walking off the stand after telling the courthouse how her ex-husband had sexually assaulted her with a liquor bottle and threatened to kill her in March 2015 in Australia.

At the same time, Depp, who is partially sighted, stood up and moved towards the Aquaman star.

Heard seemed to physically shudder and looked terrified, taking a step back as court officials immediately turned towards Depp and put their hands up, warning him to stay away.

The actor then turned away and appeared to shrug and smiled.

Heard was led to the side of the room by the court officials before Depp went through the rear door for a cigarette during the 15-minute recess.

During Heard’s testimony, Depp has been seen hunched over a notepad where he has been writing notes and doodling. 

Yesterday, Heard also admitted to failing to pay her pledged $3.5million donation to the ACLU after claiming to have made the contribution.  

Heard said it was Depp suing her that kept her from fulfilling her pledge to donate her entire $7million divorce settlement.

Heard appeared on Dutch talk show RTL Late Night in 2018 where she said, ‘$7million in total was donated – I split it between the ACLU and the Children’s Hospital of Los Angeles. I wanted nothing.’

In court today Heard said she has yet to make the full donation ‘because Johnny sued me for $50million in March of 2019.’ 

Heard said, ‘I fully intend to honor all of my pledges. I would love for him to stop suing me so I can.’

Terence Dougherty, the ACLU Chief Operating Officer and General Counsel, testified earlier in the case and said that so far only a total of $1.3million has either been donated by Heard or on her behalf.

Of that money, Heard contributed $350,000 directly in December 2018 and she has not paid any money since. $100,000 was paid by Depp and another $350,000 came from a fund at Fidelity, an investment company. 

Another $500,000 payment came from an account at investment firm Vanguard, which Dougherty said he ‘believed it was a fund set up by Elon Musk.’ 

Heard’s lawyer Elaine Bredehoft asked why Heard accepted a $7million settlement from Depp.

Heard said: ‘I didn’t care about the money. I was told if I didn’t agree to a number it could be overturned, we would never settle. I took far less than what they were offering and what I was entitled to.’

Heard said she donated the money to charity because she was ‘never interested in Johnny’s money.’

She said ‘I just wanted my safety and my future and he compromised that….I wanted him to leave me alone. I’ve been saying that since 2016.’
