The widow of Stephen ‘tWitch’ Boss, Allison Holker, has filed a spousal property petition to obtain control of half of the late entertainer’s estate after he died without a will at the age of 40 via suicide this past December.

Holker, 35, requested in court docs reviewed by The Blast for the ‘property passing to the surviving spouse or surviving registered domestic partner without administration,’ meaning all of his assets would be put into her name.

Boss did not have a will at the time of his death, Holker said in court docs, asking for ‘confirmation of property belonging to the surviving spouse.’

Holker said in court docs that when she and Boss wed in 2013 – prior to him getting a job on The Ellen DeGeneres Show – he owned ‘owned only personal effects of little value’ with no money saved up.

Holker said that there were ‘no written agreements between’ them ‘providing for a non-pro-rata division of the aggregate value of the community property.’

The couple was seen in LA December 5, just more than a week before he was found dead 

She is requesting the court award her half of the property and holdings they accumulated during their marriage, including TV royalties.

Holker asked for ‘undivided one-half interest’ in the following assets: the company Stephen Boss Productions, Inc.; a Goldman Sachs Investment account; and royalties from Cast and Crew Production; Disney Worldwide Services, Inc; GEP Talent Services, LLC; and SAG/AFTRA.

It was not immediately clear why Holker filed the legal documents.

Boss was found dead on December 13, 2022 via a self-inflicted gunshot to the head in a Los Angeles hotel room, which authorities deemed a suicide.

Workers at the hotel where he was found said that he did not appear to be ‘visibly upset’ when he checked in for a single evening, carrying ‘one small bag’ with him, according to the outlet.

Following the tragedy, Holker, who is mother to three children with Boss – Weslie, 14, Maddox, six, and Zaia, three – told People in a statement, ‘It is with the heaviest of hearts that I have to share my husband Stephen has left us.

‘Stephen lit up every room he stepped into. He valued family, friends and community above all else and leading with love and light was everything to him. He was the backbone of our family, the best husband and father, and an inspiration to his fans.’

The family resides in a home in Encino, California 

News about the legal moves comes after the Rwandan conservation campus for gorillas that bears the name of Ellen DeGeneres has planted a tree in memory of  Boss earlier this week.

‘As we celebrated the one year anniversary of our Ellen Campus this past week, we took a moment to recognize a very special person who left us too soon,’ a statement on the Instagram account of the Ellen Campus of the Dian Fossey Gorilla Fund read Monday.

The statement continued: ‘tWitch brought light to so many and was a wonderful friend to @ellendegeneres. In his honor we planted this tree so he will be forever remembered on the campus.’

A silver plaque at the display read: ‘In memory of Stephen ‘Twitch’ Boss and the light he brought to the world. Planted February 2023.’

DeGeneres, 65, began working with Boss in 2014, as he was a guest DJ on her talk show, eventually working his way up to co-executive producer by 2020.

‘Everyone is in pain,’ she said. ‘The holidays are hard, I think, anyway, but to honor tWitch I think the best thing that we can do is to laugh, hug each other, play games and dance and sing.’

The TV personality continued: ‘That’s the way we honor him, is we do the things that he loved to do, which is dancing. He loved music, he loved games, so we do that – and I know it seems hard, it seems impossible, but that’s how we honor him.’ 

The Ellen Campus of the Dian Fossey Gorilla Fund was opened in Feburary of 2022, and DeGeneres and wife Portia de Rossi attended a dedication ceremony in June of 2022.
