Accused killer tradesman Ashley Gaddie has launched a legal fight to stop DNA evidence being used against him in court over the alleged murder of school teacher Dannielle Finlay-Jones.
Gaddie, 33, was arrested just after midnight on Wednesday after a 12-hour stand-off with police on a precarious remote clifftop in Sydney‘s Blue Mountains following a massive manhunt.
Gaddie was discovered perched on a clifftop clinging to the barrier above a sheer drop at Fletcher’s Lookout overlooking Wentworth Falls around 12.30pm on Tuesday, hours after a warrant was issued for his arrest.
The body of Ms Finlay-Jones, 31, was found in the bedroom of a friend’s home in Cranebrook in Sydney’s west on Sunday, having suffered serious head injuries.Â
Gaddie was questioned overnight at Katoomba police station where an interim order was granted to swab him for DNA.
In Penrith Local Court on Wednesday, lawyer Joseph Ormaechea opposed consent for the DNA swab taken at the police station by forensic experts.
The prosecutor warned of the need for the swab to be taken because of the ‘transient’ nature of the DNA.

Ms Finlay-Jones allegedly met up with Gaddie at The Marsden Brewhouse, in Marsden Park, on Saturday night after the pair recently met onlineÂ
Gaddie did not appear in person or by video link and made no application for bail.Â
He was remanded in custody until March 3 with a decision on the admissibility of the DNA swab adjourned also until the date.
Police rescue officers, detectives, riot squad and a team of specialist negotiators rushed to the Blue Mountains last night in a bid to talk Gaddie back to safety.
